Disclaimer of Liability - Kiwibiker NZ – Motorcycle training
I indemnify Kiwibiker NZ – Motorcycle Training, Local Bodies and Landowners, their agents, contractors, and all Officials against any claims arising from my attendance at this training event.
I am physically fit and there is no health or other reason why I should not participate in this event.I am not under the influence of drugs or alcohol or medication which may affect my riding.
I am aware that the sport of motorcycle riding on New Zealand roads might: cause me injury, serious or otherwise and damage my property.
I wish to take part in this training event despite the above risks.
Neither I nor anyone associated or connected with me will make any claim against you or your officers, employees, contractors, or agents in respect of: Any injury suffered by me, or any damage to any of my property regardless of how the injury or damage occurs.
I will indemnify you against all claims, damages, or losses (including costs), which you incur as the direct or indirect result of any injury to me or damage to my property.
I am aware that this disclaimer will not affect any legal obligations you have to me, which you cannot contract out of under New Zealand law.
I agree that this disclaimer will be binding on my family, heirs, my legal assigns and my administrators and executors.
KIWIBIKER NZ – Training and assessment Cancellation Policy
We kindly request your cooperation in recognizing that cancellations without adequate notice hinder others from attending on short notice. To ensure a smooth process, please adhere to the following cancellation policy:
Cancellation Procedure:
If you need to cancel or modify your course date, kindly inform us promptly. You can reach out via email at jared@kiwibiker.nz or through a text/phone call to 0273702926.Include your name, appointment details, and the reason for cancellation in your communication.
Payment Information:
Upon booking, a confirmation email will be sent, detailing the course date, time, and location. Payment can be made through a bank transfer to our Westpac account (J Cantlon - 03-1594-0631209-001), with your name as the reference.
• Payment in full is required at least 4 clear days before your assessment/training.
• For assessment/training within 4 days of booking, immediate payment is mandatory.
• Failure to adhere to payment terms may lead to booking cancellation, with the slot offered to another individual.
Cancellation Terms:
If you cancel:
• No refund for cancellations with less than 48 hours notice or if you fail to attend.
• More than 48 hours notice allows for a transfer to an alternative date.
• No refund for non-attendance due to weather conditions. We are not liable for non-attendance or late arrival, irrespective of the situation. Any cancellations or non-payments within the 48-hour period require the full fee to be paid.
Attendance Conditions:
You will forfeit your fee if you attend but:
• Leave the training before completion.
• Fail to bring required documents.
• Have a non-roadworthy vehicle.
• Possess an inappropriate or illegal motorcycle for your license.
• Are suspected of drug or alcohol influence.
• Lack adequate protective clothing and gear.
Cancellation by KIWIBIKER.NZ LTD:
If we cancel your course for any reason, we will attempt to reschedule. If not feasible, a full refund will be offered. By booking your appointment, you confirm understanding and agreement with this cancellation policy. We appreciate your cooperation in maintaining the quality and accessibility of our training programs.
